Sawm: Haram

SINFUL FASTING
Haram
(sinful, prohibited, forbidden)

DAYS OF EID

  • Eid Al-Fitr (Shawwal 1) and Eid Al-Adha (Dhul Hijjah 10)
  • These are days of enjoying, celebrations, eating, drinking…
  • Umar Ibn Al-Khattab (Radiyallahu Anhu – may Allah be pleased with him) said: “There are two days that Allah’s Messenger forbade fasting during them.: the day you break your fast and the day you eat from your sacrifice.”  [Muslim]

AYYAM AT-TASHRIQ

  • Dhul Hijjah 11-12-13
  • These are the continuation of Eid. “Do not fast these days, for they are days during which you eat, drink and remember Allah.” [Imam Ahmad, and refer to Sahih Muslim]
  • Ayyam At-Tashriq (days of meat drying by hanging meat under the sun)
  • Exempted: Those on Hajj without Hadi and those who are not on Hajj
  • 13th is an exception because it is also one of the Ayyam Al-Bayd

SPECIAL DAYS IN ISLAM

  • Al-Isra Wa Al-Mi’raj (Rajab 27)
  • Mawlud An-Nabi (Rabi Al-Awwal 12)
  • Sha’ban 15: can fast if intention is for Ayyam Al-Bayd

WIFE FASTING WHILE HUSBAND IS PRESENT

  • Abu Hurayrah (Radiyallahu Anhu – may Allah be pleased with him) reported that the Prophet ﷺ said: “A woman is not to fast [even] for one day while her husband is present except with his permission, unless it is during Ramadan.” [Ahmad, Al-Bukhari & Muslim]
  • Scholars interpreted the above mentioned Hadith as forbidden, the husband is allowed to end his wife’s fasting if she fasted without his permission and he seeks his right [to sex] from her. The same ruling applies for days other than those of Ramadan in which case she does not need her husband’s permission
  • Similarly, if she fasted without his permission because he was not present, he has the right to end her fast when he returns
  • If the husband is sick or incapable of intercourse, it is permissible for the wife to fast without his permission, that is similar to the case where the husband is not present

SIYAM AL-WISAL صيام الوصال

  • Fasting consecutive days without eating at all
  • Abu Hurayrah (Radiyallahu Anhu – may Allah be pleased with him) reported that the Prophet ﷺ said: “Do not perform Al-Wisal.” He said that 3 times and the people said to him: “But you perform Al-Wisal, O Messenger of Allah!” He said: “You are not like me in that matter. I spend the night in such a state that Allah feeds me and gives me to drink. Devote yourselves to the deeds which you can perform.” [Bukhari and Muslim]
  • The scholars say this prohibition implies that the act is disliked
  • Ahmad and Ishaq say that it is allowed to fast until the time of the pre-dawn meal as long as it is not a hardship on the one fasting. This opinion is based on what Bukhari recorded on the authority of Abu Sa’id al-Khudri: “The Messenger of Allah said: ‘Do not make Al-Wisal. If one of you insists on making Al-Wisal, he may continued his fast [after sunset] until the time of the pre-dawn.”

HAID AND NIFAS

  • Having menstruation and post-childbirth bleeding
  • The Prophet ﷺ said: “Does she not refrain from praying and fasting during her menstruation?” [Bukhari]
